case that was dismissed

my brother while he was a juvenile was accusedof rape. the case was dropped, this was in dec 2003. he has come up for the holidays and the plantiff found out he was up called the police and was arrested. what can we do what is his rights??

There are many question such as when was it that the offense is alleged to occurred. There is a statute of limitations. What was the nature of the dismissal, meaning was the dismissal based on the alleged victim

There is something wrong with this picture. Someone has made a mistake. It may be the police. It is more likely that it was your brother.

What makes you say the case was dismissed? Why was it dismissed? Was it dismissed without prejudice? That means it can be reinstated?

I would not count on a dismissal, or any defense based on the dismissal. Get your brother quality legal representation. NOW.
