Legal Question in Criminal Law in New Jersey

Caught with prescription drugs but no prescription

Hi. I'm asking for a friend of mine that was stopped and had a variety of pills in a container in case a sympton arose and she needed one. They are old pills she had from awhile ago and no longer has the container and the doctors or pharmacys don't keep records over 2 years. What is the maximum fine or sentence my friend could get. She is 57 and has never been in any kind of trouble before, has always lived in the same house, has always worked, and is scared to death and needs a psychiatrist at this point. Your help is appreciated as my friend cannot eat, sleep or function right now.

It sounds like your friend is charged with either a fourth or fifty degree crime. A fourth degree crime has a maximum sentence of 18 months and a fifth degree crime has a maximum sentence of five years, but it is presumed that a first offender will get probation instead of a jail sentence.

Additionally, there is probably a way to prove pills were obtained legally which you have not thought of.
