Legal Question in Criminal Law in New Jersey
Hi I was caught shopliftin in new jersey.When i was caught i resisted.Will I be indicted for robbery?if so how long will the process take.This is my second shoplifting offense.the first one was in 2005.If i am indicted will I be able to get a PTI or have the charge downgraded to municipal ordinance if I take shoplifting classes and prove that I am remorseful?

With respect to the shoplifting, the dollar amount determines whether you will be indicted. It is only robbery if you used force to steal whatever the item was. You may be indicted for the resisting depending upon the circumstances. If you have a prior conviction it may be very difficult to get PTI, plus the fact of the resisting can possibly prevent you from getting into PTI. Resisting apprension when confronted by store security sometimes turns a shoplifting case into a robbery case. This is because shoplifting is form of theft and a robbery is a theft accomplished with threats of injury or actual injury.
