Legal Question in Criminal Law in New Jersey

Changing real estate bond to different property

What is the possibility of replacing one piece of property with another of equal value. I bought a house and was in the process of selling my old house when I had to use it as collateral to get my brother out of jail. I have since bought another house and can not sell the other house because of the lien on it. I can't afford to pay mortgages on both. What are my options besides renting out the original house (with the lien) Will they let me change one property for another? They both have the same value and equity. Will they release the lien if he goes to jail?

Thank you

Re: Changing real estate bond to different property

If you used a bondsman, you should simply ask the bondsman to allow the substitution. if you put your property up with the court to satisfy the bail requirement, an applicatin has to be made by an attorney for a court order allowing the subtitution of the property.
