Legal Question in Criminal Law in New Jersey

New Charge

My boyfriend has 2 open cases and was just arrested on another charge which is burglary. Before his recent arrest he was offered probation for the other 2 charges. What would be the penalties for this new arrest?

Each case is unique so it is impossible to say what his potential sentence would be. However, if this is a third charge,and it is for a serious charge like burglary, then he is probably looking at some amount of jail time. He seems to be determined to go to prison. Getting new charges while charges are pending is not a good move.

I doubt the probation offer is still on the table with a burglary now in the mix...

You need to consult with a lawyer to review all the cases and see what can be done. When was the "new" arrest? Is he on bail?

NJ grades criminal charges by degrees. 4th degree is relatively low, while 1st degree is the worst. If your boyfriend was offered probation for 2 charges, they were probably 3rd or 4th degree crimes. Burglary, however, can be a 2nd degree crime. The maximum penalty for that is a possible 10 years in jail and a fine of $150,000, or higher based on 2 times either the "gain" to the defendant or the "loss" to the victim.

Somebody with a clean record will generally not get jail time for a 3rd or 4th degree crime, while even somebody with a clean record will usually get jail time for a 2nd degree crime.

Your boyfriend definitely should not try to handle this on his own. There may be technical issues in search and seizure, the arrest, perhaps warrants that could make the difference between going to jail for a long time and possibly walking.
