Legal Question in Criminal Law in New Jersey

charge filed against me

a customer is charging me with 2C:33-4A, she is specifically saying that I told her to ''get the f--- out of his store''. my question is: even if she is right about me saying that to her, do i have the right to curse at someone on my private property in the heat of a verbal argument?

Re: charge filed against me

The key element of the charge brought against you is your engaging in the subject conduct with the purpose to harass. This purpose must be prove beyond a reasonable doubt. Under the scenario which you outline it would appear that your purpose was to motivate the person to vacate your store quickly. You need the services of an attorney.
