Legal Question in Criminal Law in New Jersey

charged with 2C:33-2a in Belmar

My brother was hassled for having Alcohol on the beach and then was charged with Disorderly conduct. From what I have read his charge is due to 2C:28-3, giving false information. What degree of disorderly conduct would this be considered and what is the min/max penalty?

You want to make sure that there is no "2C" conviction on your brother's record. It will show up on a criminal case history ["CCH"] and cannot be expunged for at least 5 years. The matter will probably be heard in the municiapl court of Belmar which has a restriction of six months in jail. It is however highly unlikely that any jail would be assessed but it is possible. The fine will probably be high but more importantly if convicted he would have a criminal record so he may want to consult an attorney. John Ducey

2C: 28-3 is entitled "Unsworn Falsification To Authorities" and

is a disorderly persons offense or a

fourth degree crime. If it is a disorderly persons version of the offense the maximum jail sentence is six months and the maximum fine is $1,000. If it is a fourth degree crime

the maximum jail sentence is eighteen

months and the maximum fine is $10,000.
