Legal Question in Criminal Law in New Jersey

I am being charged with second degree eluding and I was not the driver. When the driver crashed the car he immediately jumped from the front seat to the back seat and I stayed in the passenger side. Since the car was in my name the police charged me with eluding. I have no witnesses willing to confess that I wasn't driving all I have is my word that I was not driving. Any suggestions on what I can do in this situation?

Yes, get a good attorney and fight the case with everything you have. I would want to get a pre-trial hearing to lock some of these officers into a story and then take the case to trial. On a second degree charge you are facing mandatory state prison time, so it is essential that you hire an attorney right away. Regarding the charge itself, if you are innocent then you cannot accept any plea offer and either have to try and get the charge against you dismissed or take the case to trial and try to win it that way.
