Legal Question in Criminal Law in New Jersey

Charged with NJS 2c:35-10A(4) in Belmar no priors in NJ but elsewhere

I was in NJ a few weekends ago visiting some friends unfortunatly charged with a NJS 2c:35-10A(4) I dont have any prior drug convictions in NJ or elsewhere, but I am currently enrolled in a PTI type program in CT for a non-drug related matter. There are a few things I am worried about. 1. Am I eligible for PTI? 2. Will my CT record show in NJ? 3. Should I hire an attourney or will I more than likely recieve PTI? 4. Any attorneys willing to take on this case?

Since you have no prior drug offenses you may be eligible for the municipal court drug offense form of PTI known as a Conditional Discharge. Your CT record will show up in NJ due to the interstate compact that allows access to your record nationwide. Since this is a type of criminal charge I would advise you to consult with a lawyer - there may be a way to actually beat the charge, and the offense out of NJ may cause problems with your continuing to be enrolled in PTI in CT. You seem to be charge with possession of less than 50 grams of marijuana or less than five grams of hashish. These are disorderly person offenses which are to be heard in municipal court. The first offender statute which applies to these offenses relates only to one being a first offender as to committing some variety of drug offense. Technically you are still a first offender so far as the drugs are concerned, but you do require the services of an attorney because this position may have to be argued in Court.

I'm in Belmar quite often and was actually there last week. There is no PTI in municipal court, but there is a conditional discharge. However, its not like in criminal court where they let you in without any argument. I would get an attorney to argue on your behalf as the CT PTI may cause a problem and its not going to cost you that much at all. Furthermore, your case may be such that the evidence can be thrown out. The Judge in Belmar is also a really great Judge, so you should have a good chance of getting a fair hearing.
