I have been charged with and would like too know more about

I have been charged with and would like too know more about

NJ.S, 2C:24-4A. I was also charged with a DWI and recless driveing, thought I was not driveing i was just sitting in a car with the keys in the ignition. The minor in volved in the matter was a friends daughter. I would like to know what this law is about and what can happen too me.

That statute reads:

2C:24-4. Endangering welfare of children

a. Any person having a legal duty for the care of a child or who has assumed responsibility for the care of a child who engages in sexual conduct which would impair or debauch the morals of the child, or who causes the child harm that would make the child an abused or neglected child as defined in R.S.9:6-1, R.S.9:6-3 and P.L.1974, c. 119, s.1 (C.9:6-8.21) is guilty of a crime of the second degree. Any other person who engages in conduct or who causes harm as described in this subsection to a child under the age of 16 is guilty of a crime of the third degree.

I would need to know more about the situation to give you an opinion.

The endangering charge, NJS 2C:24-4, is serious. A conviction on the third degree potentially exposes you to 3-5 years. In the event you could be charged of the second degree offense, the sentencing potential is 5-10 years. Having an attorney involved at the earliest possible moment MAY provide an opportunity to persuade the county prosecutor that the charge is overkill. This is particularly true since there is now an ehanced penalty for DWI with a minor in the car which is not as severe as an endangering charge. You should retain counsel as quickly as possible.

This is very serious charge. It is the charge of Statutory rape. If found guilty of being with the minor not only are you facing 5-10 years in Jail. You will have to do 85% of the sentenced imposed. That is not all, megan law applies, which means you have to register for the REST of your life with your local police deparment as a sex offender. If that is not enough, you will also have to go to a program called avenel for a sexual evaluation by a medical professional.

Based on the information you entered, it appears that you are facing two sets of charges - traffic violations such as the DUI/Reckless and the 2C charge which is probably either a 2nd or 3rd degree felony depending on the exact facts involved. If convicted on all charges, for example, you are facing license suspension, points, high fines, a possible criminal record, and possibly jail.

However, based on the limited facts, I can only respond to the charges you entered without doing any analysis. Many factors specific to your case may make convicting you of these charges difficult or impossible. There is also the possibility that you may be able to enter a plea to a lesser charge or enter a Court diversionary program.
