i got charged with possessing a cds,hyrocodone with a weight under 1/2 ounce,got relased on a summons,in Atlantic City N.J. it got sent up to the county prosuter,do ya think i'll get intited and whats the max peantly

I need to have the exact 2C citation to know exactly the schedule of the drug that you are charged with possessing, but it is probably a third degree offense with a maximum sentence of

five years. If you are a first offender you are eligible for a conditional discharge.

As for your getting indicted, it seems likely give the weight of the drug.

As a derivative of codeine, this is what is called a Schedule 1 substance. by definition this makes it's possession a third degree offense which carries the potential penalty of up to five years in state prison. There is a good possibility that you will be indicted, however due to the relatively small quantity it may get remanded to the Municipal Court (not likely in my opinion). On any criminal charge you should at least speak with a lawyer before doing anything with the court system. Please contact me to discuss your case in more detail.
