charged with theft by deception

my previous employer may charge me theft by deception for for giving surveilance work from my office to other investigators.but during this time he was paying me off the books,and i was not registered as an employee by his company to the state.can he still proceed

He can contact the police and try to convince them to bring a charge against you even though you were not listed as an employee. If this happens, then please contact my office to discuss your charge. Yes he can proceed, one has nothing to do with the other. You need to get an attorney ASAP and do not speak to anyone about this accept your lawyer. Remember you have the RIGHT TO REMAIN SILENT.
