Legal Question in Criminal Law in New Jersey

can she be charged with theft by decieption?

we we lived together for 20 of our 23 yrs together. She lost her job and when her unemployment ran out, couldn't pay her half of our rent and her Car insurance and cell bills. I lost my army& navy store, filed bankruptcy ect. We got evicted and she went to live with her daughter and I to a motel studio room. For over 2.5 years she lead me to believe that we were still engaged. She decived me to believe that we were still a couple so that I would pay her car insurance and cell bills. I paid $9.738 that I have the reciepts for.

Rather than posting the question on this cite, you should talk to a police officer near where you live to find out if they view it as a theft situation if you wish to have her charged with a criminal offense. In a civil context you could try suing her for the money, I would need to research it and I am not certain if you have a breach of contract situation. What was the circumstances surrounding your so called engagement? Did you give her a ring? Did you ever discuss marriage? If you paid her bills while you were dating and/or together as a couple I am not certain that you would necessarily have a claim to get that money back. again, if you wish to pursue possible criminal charges you need to speak with the police. It would probably be quite difficult to prove intent if you were merely a couple and she just chose to end the relationship. I would be interested in knowing all the facts but it sounds like it would be difficult to pursue either from a civil or a criminal angle. Again, to start speak to a Law Enforcement officer to get their opinion on whether you potentially even have a criminal case. Please feel free to call with any questions (201)-342-5030
