Legal Question in Criminal Law in New Jersey

Citation

I got a citation for simple assault. After several weeks of waiting for a court date and did not receive one, I called the courts and they said I don't have to come to court because there won't be any charges, so just disregard it. Do I have a record?

That is really odd. First, yes, there is a record of arrest. You will need an expungement if you want to get rid of it. I'd be happy to discuss that with you in more detail Second, this is an odd situation. I suggest you obtain a certified disposition from the court to protect yourself. This is the only way you can be sure it really was dismissed.

You should go to the court and ask for a record of the dismissal of the charge because courts do not normally dispose of cases without a court appearance by the defendant. Be careful; someone may be deceiving you about there being no case.

something does not sound quite right. Court appearance is required if a criminal charge has been filed against you. If you were arrested, you will have an arest record even if the case is dismissed, or if there are no charges.
