Complaint Warrant (Paterson)

I have been in contact with this office and was informed that I must turn myself into the authorities on 8/2/07 and I would be arrested for the charge of Theft by Deception 2C:20-4A ($162,964.00) and no bail would be set until I appeared for a pre-indictment hearing 8/21/07. Why is their no bail or can a bail be set for this matter and could this be accomplished.

I believe a bail could be set prior to your surrender but given the amount of the theft there may be no 10% cash alternative. You would need a bond, cash or property (more than the amount of the loss) to satisfy the bail set.

You should try and work the details of this out ahead of time so as to avoid an incarceration on 8/2/07. I have done this in Passaic County and it has worked out pretty well in the past.

The judge sets the bail, and in your case apparently he decided that the charges were serious enough not to warrant any bail. The hearing on August 21 will at least partially be a hearing to determine how much, if any , bail you should be allowed to post. You definitely need a lwayer for this charge, whether a private lawyer or a public defender. I am an attorney who has handled many cases similar to yors in various courts in NJ in the past. Just wanted to add my two cents. You should first hire an attorney (if you plan to at any time) and then set up the bail bondsman. Even if you don't want to use my firm, I can give you a name of the only bail bondsman I trust. He doesn't work for me or anything like that, I just have dealt with many and this is the only one I would ever use.
