Complaint-Summon ticket
Hey,
This past weekend I got a complaint-summons ticket in Paterson, NJ for loitering to commit cds. Im really scared because I was not waiting to buy drugs. I want to know what a complaint-summons ticket is and what happens now? I know I'm innocent and I don't want to be charged with something I didn't do. Please help.

Basically, you were charged with hanging around a known drug area with the intention of buying drugs. The maximum penalty for that is a $1000 fine and 6 months in jail, plus having a record that could cause you problems in the future.
Especially if there is no evidence you were involved in a drug transaction, you very well may be able to beat this.

I was just up there last Friday. Call me at 732/247/3340 to discuss. These charges can be tough for the State to win. Thus, you probably have some great defenses to the charge.

Loitering to obtain or distribute CDS 2C:33-2.1. "Public place" defined; Loitering to obtain or distribute CDS is a disorderly persons offense 1. a. As used in this section:
"Public place" means any place to which the public has access, including but not limited to a public street, road, thoroughfare, sidewalk, bridge, alley, plaza, park, recreation or shopping area, public transportation facility, vehicle used for public transportation, parking lot, public library or any other public building, structure or area.
b. A person, whether on foot or in a motor vehicle, commits a disorderly persons offense if (1) he wanders, remains or prowls in a public place with the purpose of unlawfully obtaining or distributing a controlled dangerous substance or controlled substance analog; and (2) engages in conduct that, under the circumstances, manifests a purpose to obtain or distribute a controlled dangerous substance or controlled substance analog.

This is a type of criminal charge and you are facing the possibility of jail time, having a criminal record, and having to pay high fines. Obviously, you need to hire an attorney. You are charged with a disorderly persons offense which has to do with drugs. A conviction will hurt your employment prospects.
