Legal Question in Criminal Law in New Jersey

Computers seized

I was arrested on book makingcharges back in 2004, they seized computers and it was never listed on discover. Now state says they are taking info off computers this week after 2 years, and will be part of discovery. Is this allowed? Don't they have certain time to take info off computer. thank you

This just sounds like a crazy situation. They should have filed for forfeiture by now. While speedy trial is never really an issue in NJ, at this point I would suggest you file for one. More importantly, do you have a lawyer and what is he or she doing? I am really concerned that, one, this has been going on for two years, and two, you have to ask this question on this BBS.

The question is whether the computer

has been properly safeguarded so that

what was found thereon is not less or more or different from what was on the computer when it was seized.
