Conditional discharge

I was hoping someone could help me with my problem. When I was 20 (currently I'm 26), I was arrested with marijuana, and charged with possession. I received a conditional discharge and successfully completed the terms of my probation. I'm now in grad school for clinical psychology, and I am looking to become a school psychologist. I was wondering if the conditional discharge will show up on my background check, and if so is this a valid reason for an employer not to hire me? If it does show up on my record, is there a way I can have it expunged? And what does an expungemnt generally cost? It was a stupid mistake on my part when I was young, and would hate to see a mistake like that ruin any chances for employment. Thanks!

You need to retain an attorney and have a petition to expunge your record filed. Once it is filed, it takes 4-6 month to remove it from your record. Once this is done the arrest will not show up.

You should call my office immediately to schedule an appointment to discuss expunging the record of your arrest. An arrest without a conviction should not be counted against you but it might be held against you without the admission of same.

Yes, the arrest and Conditional Discharge should show up on your record check. It is possible that, due to poor record keeping, it may not show up, but you cannot truthfully answer that it never even happened if you do not have the matter expunged. You can also pull your NJ and FBI files to see for yourself exactly what information an employer is going to see.

Conditional discharge

The prior arrest WILL show up on a criminal records check. Whether it will prevent you from getting a job is completely up to the discretion of the person doing the hiring. However, given our society's drug war insanity, it would likely present problems for your application.

You do need to have the arrest and CD expunged from your record. If you do not you run the risk of an employer not hiring you. Although it happend years ago, I could see someone having a problem especially with the field you are in.
