Legal Question in Criminal Law in New Jersey

Conditional Discharge Probation

If you were to be released six months early from conditional discharge probation that was sentenced for a year, you submitted a urine drug test on the last appointment, finished paying the fine, and requested the expungement package for first time offenders, is there a possibility that the court can make you submit another drug test in order to complete the expungement process? Also, I was wondering how long does it take for the probation officer to receive the urine test results after the first drug test?

Re: Conditional Discharge Probation

I get the feeling that there is a fact that you are leaving out such as

your using drugs again before the end of your first offender supervisory status and/or that you have returned to illegal drug use.

If you get arrested again for drugs before your case is dismissed you will be terminated from your conditional discharge status and face prosecution on the charge which was to be dismissed.

If you test positive without being rearrested for drugs it is possible to reinstate your conditional discharge status with the use of an attorney.

Call me if you like.

I agree with Mr. Moore. Sounds like you have some problems. You may not need an attorney now, but you should have a few numbers handy.
