conditional discharge
I was sentenced to a conditional discharge for posession of a hypo. Needle in new jersey and when I went to see the probation officer for the initial mandatory visit I failed for heroin,the probation officer than told me I had to get into a drug rehabilitation program which I signed up for and am currently attending now its one month away from my 1 year c.d. Sentence so I was called back to take a mouth swab which I failed once again for heroin while still currently attending the program..my question is can or will the courts reinstate my c.d. Or do I need an attorney to advocate for me?is failing a urine while in treatment as bad as catching new charges,if anyone can help answer this question,thank you..by the way I don't have any adult convictions and is my first offense with the law

You should probably hire a lawyer since you are facing an actual criminal conviction and going to jail if you go to court on your own. You should really have an attorney ASAP to help you out here. If you violate your CD, the charge will get reinstated. However, I would first try to get the CD to stay in place. Call me at 732/247/3340 to discuss.

You need the services of an attorney because you are presently heading back to court to continue the prosecution which you avoided by getting first offender treatment.
