Legal Question in Criminal Law in New Jersey
Conditional Discharge Violation?
I was granted Conditional Discharge for possession of marijuana in April, and I recently was arrested and charged with disorderly person, reckless driving, and possession of fireworks. Could this be considered a violation of the CD?

Re: Conditional Discharge Violation?
Yes, of course. However, a lot will depend upon whether or not you are convicted. I strongly urge you to call an attorney ASAP.

Re: Conditional Discharge Violation?
The requirements of your conditional discharge should have been explained to you when you were placed on same. If you have violated any of the terms of the status should be something you already know. Had you tested positive for a drug you clearly would be in violation of your status. Should you be found guilty of any of the new criminal offenses you will probably be in violation of your sttus. Reckless driving would not be a violation because it is not a criminal violation but a motor vehicle violation. Hire an attorney; you are in considerable trouble.
