Conspiracy with intent to distrubute
Our apartment got raided cause my roomates where involved in drug dealing. I had nothing to do with it. I got charged with conspiracy, agreeing to sell drugs cause one of my roommates got scared when the dectives told him he was getting like 25 years in prison. He had 2 ounces of cocaine and sterods. He told the detective that half of it was mine. He aplogized to me and said he will pay for my attorney fees. He is getting one year in county. I didnt qualify for pti cause I had a conditional discharge 5 years ago. Can my roommate tell the judge or proscuter the truth. Will that dismiss my charge. Will he get penlized for lieing on his statement? Please give me some helpful advice.

Your roommate certainly complicated the situation. It may be difficult to undo the damage that he has done, but it is possible. The prosecutor can decide to dismiss the charges. However, it may be that you will have to push the matter close to trial, asserting your innocence along with your roommate's current assertion that you were not really involved.

You are facing 5 year with 3 years parole ineligablity assuming the weight is with in 3rd degree. Distribution in NJ has a mandoatory Min of time in Jail without parole. If this is your 1st offense, you may be able to get 3 with 9mths.
