Legal Question in Criminal Law in New Jersey
constitution as well as nj law in rules governing criminal practice states 8 things that lawfully should occur at the first appearance after filing complaint in the 72 hours after arrest. what happens when 2-3 of those things don't occur in a certain county, not just to a certain individual but systemically? in addition, if this appearance doesnt take place even as far as two months down the line of incarceration. what is the recourse? Are these things grounds for immediate dismissal?
