Legal Question in Criminal Law in New Jersey
How can someone be convicted of a crime, when no evidence was found?
I am being tried by the state of NJ for a crime I didn't commit. They want me to plead guilty to gun possession and receiving stolen property. the way they are trying to convict me is with a law called ''conjunctive possession.''
A friend of mine committed carjacking of a Cadillac Escalade
he has since been convicted of the crime. He now states that
I was the mastermind of the incident. The police did recover the truck @ my job(verizon). I was @ my job when the incident happened and I did run from the scene (guilty for that). The police recovered along with the truck, a bulletproof vest, stun gun, and a handgun not inside the Cadillac that was stolen, but inside another vehicle park in the parking lot and belonging to someone else. when we started going to court for the discovery phase, the prosecutor stated that no evidence was found in the vehicle with the gun,stun gun, and vest in it. there was no fingerprints anywhere in the vehicle or on the the vehicle, also the registration and other paperwork showed the car belonged to someone else. The only thing they have on me is the fact that I ran from the scene, which I do admit, and this thing with conjunctive possession. I feel like I'm being sent up for nothing. Please Help!!!!

I'm sure you have an attorney. It is call "constructive possesion". It sounds like you shold go to trial. What did they offer you and what did they want you to plead to? I am sure you understand that you are facing a lot of time in State Prison.
