Legal Question in Criminal Law in New Jersey
are cops above the law?
lets say a wife is being dropped off at her house by an off duty police officer and before he leaves the property, overhears an argument between the husband and wife after she goes inside. the officer then proceeds to sneak up the stairwell to the apartment, bursts through the door and assults the husband because he says he hears her say '' dont choke me''. Is he by law alowed to do that?

If you were in an apartment being choked to death and you yelled out for help and a police officer responded by knocking down your door would you think he acted unreasonably?

Re: are cops above the law?
If a police officer has probable cause to believe that a crime is either being committed at that time or is going to be committed immediately thereafter then he can act as you stated in your question. You don't say that you were actually charged with a crime, but if you were please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
Sincerely yours, -Ronald Aronds, Esq.-
