Legal Question in Criminal Law in New Jersey
Cops''driving'' vehicle away to police station to do there search for drugs, ille
Yes i wanted to know if it is legal for a cop to stop you and pull you out of your car and tell you your under arrest and hand cuff you, beat you up and then search your car and didnt find anything and gets mad and drives your car away to the police station to be searched once again and then 15-20 later they say they found drugs and then was charged.I would like to know from a Lawyer can this be law,is it legal or illegal for cops to take your car and drive it away after being searched in front of witness and didnt find anything and then they jump right in the vehicle that there trying to find something illegal and didnt find anything then the cops then drive it away and then say that they found something? And a few days later officers of there family said that when they heard the news they said that what the officers did was illegal & not proper, that they was not suppose to drive the car off that it was suppose to be towed away by a tow truck. And this came from the mouth of officers of the family. Can this be beat and thrown out of court and is it illegal like the officers of there family has stated? Thanks God Bless

Re: Cops''driving'' vehicle away to police station to do there search for drugs,
Sounds like a very illegal search which should result in the court suppressing the use of anything "found" by the police from being used to prove a case against you. Dismissal of the case seems likely.
