The degree of the charge against you depends upon the value of the property stolen. Unless this happened on federal property, the case would either be heard in the state superior court or the local municipal court. Either way, if you are convicted you would have a criminal record and face penalties that include fines, jail time, and possible loss of professional licenses. The seriousness of your charges is determined by the statute under which you are charged and the value alleged for the item stolen. The theft of an item worth $200.00 or less is usually a disorderly persons offense. A theft of an item worth between $200.00 and $500.00 is a 4th degree crime with a

maximum sentence of 18 months. A theft of an item worth $500.00 or more is a third degree crime with a maximum sentence of five years.

If you are a first offender you are probably for first offender treatment which means probationary supervision followed by the dismissal of the charges.

I agree with the other responses. It depends on the amount of loss, whether you used the credit cards etc. to whether the charge is a misdemeanor or indictable offense. If it is your first time, you probably would be looking at probation and fines.

It wouldn't be federal, but you could get charged with a felony. Right now, I think a lot is up in the air and it could go either way. I suggest you get an attorney now so that he or she can speak with the prosecutor's office and try to get ahead of these charges before they proceed to a grand jury.
