Legal Question in Criminal Law in New Jersey

Crimal Charges - ''Eluding''

Person currently in State custody for a Parole violation � non-conclusive drug test results � officers came to the house � did not receive urine � and charged him with a parole violation.

Reason on parole � what started off to being a ticket for �eluding� � call came in at that exact time for a robbery � they pinned it on person mentioned � charges were dropped for robbery and given time for Eluding. Robbery � was not him � no evidence � and to my knowledge the person who was robbed even stated it was not the person in question.

Need someone to talk to him for a consultation � story comes best from the person involved.

Please let me know what I should do � there are a lot of things that need to be discussed.

I don't really understand the current status of the person in question. Has he been convicted of eluding already, or what. I need to get more information before I can give you a full answer. 2C:29-2. Resisting Arrest; Eluding Officer. a. (1) Except as provided in paragraph (3), a person is guilty of a disorderly persons offense if he purposely prevents or attempts to prevent a law enforcement officer from effecting an arrest. (2) Except as provided in paragraph (3), a person is guilty of a crime of the fourth degree if he, by flight, purposely prevents or attempts to prevent a law enforcement officer from effecting an arrest. (3) An offense under paragraph (1) or (2) of subsection a. is a crime of the third degree if the person:

(a)Uses or threatens to use physical force or violence against the law enforcement officer or another; or

(b)Uses any other means to create a substantial risk of causing physical injury to the public servant or another.

It is not clear what relief the person would be seeking - or if any could be obtained.

It sounds like all dates for an appeal have expired so at best there could be post-conviction relief (which is hard to get) if anything.

You need to gather up all the paperwork and sit and meet with counsel for an evaluation of what can be done.
