Legal Question in Criminal Law in New Jersey
The crime: suspected shoplifting
Mall security detains woman til police get to scene. Police cuff woman & bring her down to station. Woman is put in holding cell. 2 male police officers ask her to undress herself fully, without her consent, as they stand by & watch. It is not til after this that another officer reads woman her rights.
My question: How can this woman be put under arrest, placed in a holding cell, & told to derobe without first being read her rights? Is this allowed? Also, shldn't a female officer be present during the strip search? Makes no sense. Any info wld be greatly appreciated. Thank you.
