Criminal Charges

A person lives in Kansas but is arrested in New jersey. Don't know the charges nor the reason for the arrest, but has been in a NJ county jail since May 29th. He does not have much contact with family, but info comes from roomate who initaial talked to him upon his arrest. Roomate says that it may have to do with not paying child support payments. There is also a language barrier which is partly why noone knows anything about the inmate and it's more than 24 days. How do we find out what charges are? We have the name & phone of county jail, but no one has answered any time we have called. Can a lawyer be retained from Kansas to represent inmate in NJ? How much would this cost? What would be the best way to handle this? The assumption is that there is a criminal charge since he's been in jail this long? Will he eventually be transport to Kansas where he lives? The reason for him even being in NJ was because he was traveling and his port of entry was New York where he was taken to NJ. Any information and advise you can provide will be greatly appreciated.

There are a bunch of questions here, and in order to help you I need a little more information. First, if you can tell me what county he is being held in I can give you the correct phone numbers to call to find out your friend's status. Second, if there is a language barrier and you're referring to someone who arrived from overseas, there may be some immigration issue that is causing him to be held rather than a simple non payment of child support. If it is a simple case of non payment of child support, then ultimately all he needs to do is pay the amount owed, plus any court costs. Third, yes, you can hire an attorney from Kansas but that attorney would have to get special permission from the court to come to court in New Jersey and this isn't always granted. It would be better if you hired an attorney from New Jersey to represent him. Next, if these are charges out of Kansas that your friend is being held on, then arrangements will most likely eventually be made to have him transported to Kansas to face the charges. If it is some violation that occurred in New Jersey, then his case will be heard in New Jersey. Finally, the cost of hiring an attorney depends upon the attorney you choose and how much he wants to bill you. I am an attorney who handles criminal cases in New Jersey.
