I was arrested last month in New Jersey and charged with entering a police vehicle and removing an officer�s cell phone and car keys. This all happened after the police picked me up for suspected DWI. They did not charge me with DWI, but obviously noticed that I was under the influence of something and would not let me leave without a family pick-up. I was told that during a brief moment that they let me step outside to smoke a cigarette, I entered a police car took the car keys and cell phone that were in the car, and threw them into some bushes. At that same time the officers came outside and witnessed me doing this. I will soon have to be interviewed by the criminal division of the New Jersey superior court to see if I will be indicted on the charges (Charge #1- N.J.S. 2C:18-2a(1) and Charge #2 � N.J.S.2C:20-3a). I was never charged with driving under the influence, medication I took was the only reason I would have ever done something like this. I actually don�t have full recollection of what happened because of the medication. Can I be honest and tell the Criminal Division when they interview me that I was on this medication? Can they charge me with being under the influence now, or change my charges in any way?

I believe that the municipal court judge referred you to the county courthouse where you were required to report within 48 hours. If thatis the case your interview is by a probation officer who is part of the court for

the purpose of insuring that they know your vital statistics such as your address and telephone number. DO

NOT DISCUSS THE CASE WITH ANYONE OTHER THAN AN ATTORNEY AT THIS POINT IN TIME.

My advice to you is to exercise your right to remain silent and don't admit to anything if you are interviewed. If you are indicted whatever charges they bring can be addressed at that time, and perhaps your lawyer can use the medication you took as a means of defending you against the charges. You've got a great defense, as the other attorneys said, don't screw it up by saying anything. You should get an attorney right away as you are looking at felony charges.
