Legal Question in Criminal Law in New Jersey

Do I have a criminal record forever?

In the mid 80's (1984/1987?) I was on my way home from a bar when I was pulled over by a State Trooper. After finding a (unburned) marijuana cigarette in my car, he gave me a choice of being charged with DWI (for drinking), or possession of marijuana. Since the ''possession'' charge only carried a $200 fine and no loss of license, I agreed to accept that. (He also advised me that the ''possession'' charge would mean that I would have a criminal record).

At the time, the charge was written as ''Possession of dangerous drugs'', with no differentiation as to what type of drug(s).

Does this charge stay on my record forever? I have had no further problems with the law, not even traffic violations.

And, when I fill out employment applications, I always answer the ''Convicted of a crime'' question honestly, which I think has cost me many good jobs. (I'm honest to a fault!)

I have heard many views on this, but I would like a definite answer. Any help is appreciated.

Re: Do I have a criminal record forever?

This conviction does not have to stay on your record forever. You can get what's called an "expungement". This is a way to clean off your criminal record under certain circumstances and conditions. I believe that, based on what you have told me, that you can certainly apply to have your record expunged. I am an attorney who has handled many cases similar to yours in the past in New Jersey. Please call me at 1-908-272-0111 to discuss this matter further. There is never any charge for simply discussing a case with me. Thank you.

Sincerely yours, -Ronald Aronds, Esq.-

You need to have the conviction expunged from your record. It is there until you have a court expunge it. The process ential notifying the original court and police station etc. If you wish to discuss retaining me to do it you can call 732-286-2170 for a free consulatation.
