Legal Question in Criminal Law in New Jersey
Daniel is driving, within the speed limit, on a country road. He suddenly skids on some ice and his car slides into a ditch. He leaves the car, with the keys still in the ignition and asks for help at a nearby farmhouse. The farmer calls for a tow truck and he gives Daniel a few whiskeys since Daniel looks as though he is in a state of shock. Daniel returns to the car to wait for the tow truck. However, a police car arrives and Daniel is subsequently charged with being in care or control of a motor vehicle while impaired by alcohol (contrary to section 253 of the Code). Is he likely to be found guilty of this offence?
