Legal Question in Criminal Law in New Jersey

My daughter was arrested becuase of having a bebe gun in her car. the car was searched without permission. The police responded to a fight she and another girl were having. Right now she is in jail for this and my questions is, will a judge dismiss the charges because the car was searched without permission or warrant?
