Legal Question in Criminal Law in New Jersey

My daughter was a passenger in a car that got searched and marajuana was found in a cigarette pack. Both are 18. The driver took full responsibility saying it was his. He went to court and was told to apply for a public defender. His father found out about it and got a lawyer and is making his son say it was my daughters. She is on probation (PTI) and drug tested. Can they turn around now and charge her with possession and violation of probation?

Yes, as long as they act before the statute of limitations has run. The authorities do not have to accept the driver's statements; they may believe instead that he was trying to protect your daughter from the harsher consequences she would face.

In general the answer is YES, but I would need to see the police report to determine the likelihood that they will. If your daughter is chargedthen she will need a lawyer as well since the penalties are pretty severe if she is convicted, and there is the additional problem of the charge resulting in a violation of her PTI.
