Legal Question in Criminal Law in New Jersey

dealing with the prosecutor

If a person is arrested for a drug offense and an accomplice is not charged and there's prove of their involvement, also police reports are inaccurate and there's prove of an unauthorized ''no knock entry''can this be use as leverage for plea bargaining to convince the prosecutor for admittance in PTI program on a 2nd degree drug charge?

Who represents you at this point....that is where you need to start the process because good representation gets results. The prosecutor evaluates all aspects of their case, including possible pre-trial motions, when looking at "diversion" programs (there could be more than just PTI available here). But it all starts with the right attorney for the job. Choose wisely.

I practice throughout new Jersey and Southeastern PA.

Re: dealing with the prosecutor

Of course but these types of questions bother me. Are you an attorney? If so, you shouldn't have to ask this question as you have no business in representing criminal defendants. If you are not an attorney, your attorney must be inept. Do you honestly think that your attorney is going to take advice from you because of something another attorney said on this site? I'd really like to have more info on this as none of it makes sense.
