do you think the law will change how they concider these cases right now, it is under the violent crime act. with no previous record they have to serve 85% of their time, do you see any change for that? please know i understand the victims pain and there rights but it is also an accident my son is the most non- violent person you could meet..

I don't think the law is going to change any time soon. The immediate issue is making sure your son has a lawyer to represent him on this very serious charge. No. They actually made this crime more serious and the trend is to make crimes more serious, not less serious. If you really want to help your son, do everything it takes to get him the best attorney you can afford. Call me at 732/247/3340 to discuss.

Death by auto involves gross negligence. If your son were only ordinarily negligent, he would be not guilty and should go to trial.

I should correct my answer. Your son would be guilty if he recklessly operated a motor vehicle causing a persons death. If he were only careless
he would be not guilty.
