Legal Question in Criminal Law in New Jersey
if a defendant is charged with killing someone with his truck and the state destroys the truck before trial, should defense counsel ask for the case to be dismissed for the destruction of evidence?

If the truck could be deemed evidence useful in the defendant's case a dismissal motion would seem appropriate.
