Legal Question in Criminal Law in New Jersey
Detox/Rehab instead of Jail
My daughter who is 33 has been using various drugs both legal and illegal for many years. Things are getting worse and we are concerned about her safety. We are trying to arrange an intervention and get her into a detox and rehab program. We feel that if she does not agree to this that we need to try to get her arrested and forced into a program. She had spent spent 3 years in jail after being arrested for possession and then blowing off probation requirements and drug court. If she refuses the intervention, detox and rehab, can we ''blow the whistle'' on her and be assured that she will be sent to detox and rehab instead of just being thrown in jail ( we believe she is now using heroin) without having the benefit of a detox and rehab program? Also, how does the fact that she is a convicted felon effect how this will be handled by the police and prosecution? Thank you.

Re: Detox/Rehab instead of Jail
Your motives are good, but once you bring in the police, you lose control. You cannot be assured that she will be given treatment and not simply locked up. Whether this happens will depend partly on where she is (which county) and partly on who is handling her case. Call me if you would like to discuss it further at 877*688*3879.
