Legal Question in Criminal Law in New Jersey
Disorderly Person Conviction
I pled guilty to a DP for alledgely having violating a restrainning order. When applaying for jobs, the question comes up about if ever convisted or pled guilty to a crime and/or misdemeanor. What type of offense is DP in New Jersey and can I answer the above question with a ''NO''?

A disorderly persons offense is equivalent to the
popular concept of a misdemeanor, but New Jersey does not use the term "misdemeanor" in it's criminal code. You should be answering that you have a misdemeanor conviction.
If your disorderly persons conviction is at least five years old you can expunge it and lawfully answer in the negative.

Its a tricky question. The answer depends on exactly how the question is phrased. The safest way to deal with it is to discuss it with a lawyer for guidance, and to have the conviction removed form your record of you are eligible. Call me if you would like to discuss it further at 877*688*3879.
