Divorce mess involving N.J.S.A. 2C:20-3A
I am currently charged along with my brother N.J.S.A. 2C:20-3A for taking back possession of my brothers vehicle which he is the sole owner from the front of his soon to ex-wife�s parent�s house. He had gotten notification from his insurance company that they will no longer insure him due to his wife�s driving record (dui, reckless driving, accidents etc.) He has documentation proving such.
He had no cooperation with his wife regarding the matter and understood based on a previous attempt which involved a visit to the local police station that he could not go on her parent�s property to take the vehicle without their permission. The police officer also noted that if it was in the street, that�s a different story. On that occasion the officer called the house and let them know we wanted to pick up the vehicle and we were turned away.
We had taken the vehicle about a month later from the front of the house while it was parked in the street. We had then took the vehicle to our parent�s house in the next town, took pictures of the entire vehicle and its contents, emptied the entire vehicle into boxes and garbage bags and immediately returned the contents to her house immediately where we were greeted by a detective.

Sounds like you need a good attorney than handles both criminal law and family law. I practice both, and in fact, its all I handle. I have several cases right now that are along the same lines. One may actually go to trial in a few months but I'm guessing it will be dismissed beforehand. Another one I have will likely get dismissed as well.
This sounds crazy and I suggest you move quick so that you are not indicted. Once indicted, its a lot harder to turn the ship around so to speak.

A decent attorney should be able to make the charge go away. He took his own vehicle from a pulic place. I hope the title is really in his name only.
