Domestic Violence

If someones name is on a restraining order that is against you that is not the person who actually filed the order press charges and say you violated the order and take you to court and you be held liable? If so, why can't you also have a restraining order against the same person?

If a domestic violence restraining order required that you stay away from the person filing the complaint and certain other named individuals and have no contact with them, contacting or approaching any of these individuals could be a violation of the order which can constitute a third degree crime punishable by up to five years in prison.

That does not mean that the charge can be proved beyond a reasonable doubt as required in criminal matters or that some resolution which involves the reduction of the severity of the offense charge can not be worked out. You need to hire an attorney.
