Legal Question in Criminal Law in New Jersey

driving license suspension +

My bf was charged w 3rd dregree driving suspended licence involved in fatal accident. Judge gave him 500 hrs comm svc. 5 yrs probation, 5yrs loss of license (1yr seved already and 1 day prison) Under his plea he was advised that a maximum of 3yrs probation &1yr loss license w no restitution to family. What can he do now. Also family filed civil suit and judment gramted in sum of 7.8m how is that possible when sentencing judge advised family that bf was not cause of accident.

Your boyfriend should see a bankruptcy lawyer to explore whether he can wipe out civil claim with bankruptcy attorney. As for the sentence exceeding the plea bargain it did not involve a lot more time in jail. If he were to take back his guilty plea he might be facing more prison time or maybe he wouldl not.

He could file to reduce his probation and license suspension if he was only recently sentenced.

He had an attorney for this. Where is he or she? It sounds like there is a communication break down here. He should speak to another attorney to discuss all of his options. This isn't really the forum for that.

If the judge sentences you to a greater sentence than was agreed to in the plea bargain, you can file a motion to withdraw your guilty plea and take your case to trial. Your bf should talk to the lawyer that represented him to file this motion if this is what he wants to do.
