drop terrorist threat charge - testify for grand jury
My boyfriend has been charged with terrorist threats because we had an argument and he threatened to shoot me. I know he has no gun, but I was angry and upset, because he had recently allowed a drug problem to get out of hand. Following the argument, and him getting out of my truck, I flagged down a cop and told them he had an outstanding warrant. They were unable to pick him up on the outstanding warrant. I went into the police department and they convinced me to sign a restraining order. They filed a charge for the threats. I dropped the restraining order, and now want to drop the complaint, but an investigator at the Prosecutors office said I cant, and he wants me to appear before a grand jury. I dont want to testify. Also, I feel the investigator is trying to prejudice the case by talking really bad about my boyfreind by telling me this guy is no good and needs to be put away. What can I do.

Re: drop terrorist threat charge - testify for grand jury
Both you and your boyfriend need your own lawyer. We are involved in a situation like this right now, but the underlying charge for the boyfriend is murder and we represent the girlfriend who the police are trying to get in front of the grand jury.
A lawyer has to walk a fine line between protecting YOUR rights and obstructing justice. You could be charged with a crime(s) if you fail to cooperate but if you do, your boyfriend is facing 3rd degree charges. Right now, you can't be charged with perjury since none of your statements were sworn but you could be charged with false reports which is usually a disorderly persons offense but they could charge it as a fourth degree charge for falsely implicating another.
Thus, both of you should get a lawyer right away. Feel free to contact my office for a free consultation.

You can hire an attorney to assist you in dealing with the prosecutor's office.
