Drug Posession
Hi I was recently in a car where there happened to be someone possesing a small bag of cocaine. We ended up arrested and all charged with the same offense. We all have a court appearance next thursday, I was wondering if it would be better to have a lawyer present for the case? I know about the PTI program since this is a first time offense for all the occupants of the car, and was wondering if there are any specific requirments in order to be approved for the PTI program?

Its always a good idea to get an attorney as some judges, even with first offender treatment suspend your DL.

If you all don't mind being under the supervision of the probation department for up to a year in order to have the case dismissed, it would seem prudent to have lawyers so one, who owned the drug, can admit same but not plead guilty and get first offender treatment, with the rest of you having your charges dismissed without probationary supervision.

PTI is for people who have no prior criminal history of any type. You may be eligible for PTI, but you may also have an actual defense to the case so you can get the charge against you dismissed. I would advise you to discuss your case with a lawyer before you go to court. Plesae give me a call - I never charge for simply talking to a person about their case. Thank you.
