drug possesion

my son was arrested in fort lee for drugs eluding andtampering with evidence what do you think will happen to him he lives in pa.

These are very serious charges and your son is potentially facing actual prison time. He needs to consult with a lawyer immediately to see what can be done to help him. It depends on the attorney he has. He really needs a good one. Eluding is at least a 3rd degree offense, but if he was in a car and speeding, which is usually the case, then it will be a 2nd degree offense subject to the no early release act. Thus, if he gets 10 years, he will have to serve 8 and half years before he is eligible for parole.

I believe that uncertainty about a loved one can be unendurable, but you have to understand that a criminal case is like a mysterly with no script. Usually what happens depends on how things unfold in a case.

No one can tell you absolutely what will happen, but I will tell you that since he was not the driver the charge

of edluding will not hold up. The driver is the one who has a problem with the eluding charge.

The drug charge is the real problem because of the amount of cocaine involved, but this does not preclude a disposition other than prison, but an effort must be made on a continuing basis to avoid prison.

Entering a drug rehabilitation program

raises the issue that the drug offense was the product of a drug addiction. You must remember that your son's case is very new and undeveloped. You will have to allow the case to unfold. I believe that your son's attorney is in the process of approaching the prosecutor's grand jury section.

Since this question is anonymous only I know who you are. I am doing this answer to help you to deal with the

uncertainty. Uncertainty is better than a certain unacceptable result.

The problem is that every week has a weekend when it is not possible to contact the prosecutor's office following the rejection of your son's application for the Drug Court Program

because he does not live in Pennsylvania. The rejection was on Friday and Monday will my first chance to take another tack in dealing with the problem.
