What is the worst punishment given if convicted of njs 2C:35-10 A (4) for an 18 yr old first offense. Also do we need a lawyer at the court date in municipal court.

You should ALWAYS have your own lawyer. The case against him is a serious one, there is some potential for not only a criminal record but also potential prison time associated with such a charge.

You are facing heavy fines, possible jail time, a criminal record, and loss of your driver's license. For an eighteen year old facing such serious penalties I would certianly recommend that you hire a lawyer. 6 months and 2 years loss of DL and a criminal record of course. Thus, even though are you are in municipal court, you are still looking at some tough punishment.

The worst penalties are six months in jail; twenty-four months suspension of your driver's privileges in New Jersey; $1,000.00 fine; a DEDR penalty of $1.000.00 and court costs.

As a first offender you can avoid everything except for the DEDR penalty. Get a lawyer.
