im being charged with three bags heriod in a school zone 4th degree its my first offense

This is not a fourth degree charge, it is a third degree charge and you are facing jail time on this case. I would suggest you hire a lawyer. I assume you mean heroin. If you are a first offender you can have your case dismissed as a first offender after a period of supervision by the probation department.

I agree with the previous posters:

1. It appears to be a 3rd degree charge, not a 4th degree charge, and

2. With a clean record, you may qualify for a diversionary program that would keep your record clean

The significance of 3rd or 4th degree charge is that a 4th degree charge has a maximum sentence of 18 months, while a 3rd degree charge has a maximum sentence of 5 years. Quite a difference! There is a similar difference in the potential fines.

Once again, this is not the kind of thing you should try without a lawyer. Just the other day, I had a drug case thrown out because I demanded a speedy trial and the court took too long to get to my client. There are so many little things that can make or break your case. The consequences are too severe for on-the-job training.
