Drugs and BB gun
My son has been charged with possession and selling (guilty). In his dorm room was also a BB gun which was his roommates, not his. Since the roommate couldn't pay the rent he left, leaving many of his belongings behind. The drug charge along with the presence of the bb gun makes it a mandatory 5 yrs with probation in 3 yrs. He was offered 18 mos for the drug charge consecutively. Does proving the gun was not his change anything? His roommate was not involved with the drugs. Can his roommate be charged for possession of the bbgun if he comes forward. My son is guilty of the drug charges and needs to take responsibility for his actions, but with the addition of the bbgun charges the penalty is high. The owner of the gun will come forward if he knows he will not be in trouble. He brought the guns from Pa where I understand they are legal when he moved here. He had no idea they would cause a problem here.

If the owner comes forward to admit the bbgun was his and the prosecutor accepts this claim, he might face prosecution. It would be necessary for the prosecutor to take some position as to the roommate
before he came forward.

Your son needs a good attorney. As you seem to know, he is looking at a lot of time due to the gun charge. I also wouldn't assume he is guilty of the drug charges. A felony record is the last thing he needs.

First things first, you need to get a criminal defense attorney on your team. Without one, coordinating all the pieces gets really hard. The Defender's Office, if you choose that route, is well intentioned and has quality lawyers, but there will be a huge problem with continuity....
Additionally, a good criminal defense attorney will find all options that are available for your son, and let me tell you that you haven't scratched the surface of what may be out there.

Either you have done a lot of homework on this matter or you already have a lawyer representing you. There are too many issues in your question than can be answered in a simple e-mail. Regarding the former roommate being charged for the BB gun, that is not something you even need to be concerned about. That is at the discretion of the police and prosecutor.
