I was wondering which is worst 1st degree possesion or third degree possesion? How do you get indicted

Simple posession of drugs by itself is always a third degree crime, unless the drug in question is marijuana in an amount under 50 grams. However, depending on the circumstances surrounding the arrest for posession, there may be additional charges of a higher degree than simple posession. A third degree crime carries a maximum sentence of five years in state prison. A first degree charge carries a maximum sentence of twenty years in state prison, so obviously is the much more serious charge. You get indicted when the county prosecutor takes the police report of your arrest and presents it to a group of people called the Grand Jury. If they agree that there is enough evidence to indict, they will issue an indictment. I am an attorney who has handled many criminal cases similar to yours in the past. In New Jersey crimes are number fourth through first degree. Fourth degree crimes have a maximum sentence of 18 months and first degree crimes have a maximum sentence of 20 years.
